State Law Update

With our busy schedules, it is hard to keep up with our favorite television show, let alone all of the new laws passed by our state legislature.  So for all of you on the go, here is a summary of some recently enacted laws:

  • Effective July 1, 2005, the United States flag must be displayed in each classroom of every school in an Indiana school corporation.  Daily opportunity for students to recite the Pledge of Allegiance must be provided.  However, a student may choose not to participate or a student’s parents may choose to have the student not participate.  A daily moment of silence must be observed to promote the free exercise of religion.
  • Effective July 1, 2005, an individual who serves as a volunteer or volunteer director of a not-for-profit organization that is exempt from federal taxation under Section 501(c)(3) of the Internal Revenue Code is immune from civil liability arising from the volunteer’s duties if the volunteer exercises reasonable care in the performance of such duties.
  • Effective July 1, 2005, an adoptee, who is at least twenty-one years of age and who provides proof of identification, may obtain from a person, licensed child placing agency, or a county Office of Family and Children available information of social, medical, psychological, and educational records and reports concerning the adoptee, excluding any information that would identify the birth parents.
  • Effective April 15, 2005, the Indiana Department of Homeland Security is established.  Among its duties, the department shall develop a single strategic plan for preparing and responding to homeland security emergencies and develop a plan to protect key state assets and public infrastructure from a disaster or terrorist attack.
  • And for those of you who like venison, farm raised deer meat may be sold to the public beginning July 1, 2005, provided the meat meets certain health requirements.
